中国高法内部山雨欲来 北京决策层直接主导调查千亿迷案

北京时间1月8日晚间，中共负责“指导”公、检、法等强力部门的中共中央政法委宣布介入陕西千亿矿权案卷宗丢失一案。中央政法委称已成立一个由其牵头，包括中央纪委国家监委、最高人民检察院、公安部等机构参加的联合调查组。
这一消息一经公布立刻引起人们注意。而最引人联想的是此前承诺进行“自检”的最高法更被踢出这一高级别调查组。何以如此？
2018年12月末，中国前央视主持人崔永元在举报陕西矿权案卷宗丢失后，最高法始而矢口否认，继而被迫做出“内部”调查承诺。当时，最高法发布通告称，2018年12月29日13时32分，微博账号@崔永元 发博文并附四张图片。经核实，其中两张图片所载内容与目前保存在最高人民法院档案处的（2011）民一终字第81号案件副卷的有关内容相同。已经启动调查程序。如发现最高法工作人员违反审判纪律问题，将依纪依法严肃处理。
而后，2019年1月3日，最高检检察长张军在北京出席最高检机构改革新闻发布会。回答记者有关矿权案纠纷的提问时，张军亦明确透露并表态说，涉及法院正在处理的问题，我们也都注意到了，最高人民法院内部正在展开调查，也欢迎社会知情人士提供相关情况。切实情况，我们相信会通过调查搞清楚，依法公正处理好社会关注的问题。
由此可见，最高法在高级别的联合调查组宣布介入卷宗丢失案调查之前，已经进行了长达一周多的调查。然而特殊的是，最高法内部调查结果尚未公布，中共最高层即命令联合调查组入驻。
很明显，要么最高法根本就没有进行认真调查，毕竟卷宗丢失两年都无人过问；要么最有可能的是，最高法呈报的调查结果并未令高层信服，或者说中央对最高法的“自检”不满意。
当然，有分析认为，从当事人回避的角度看，最高法为了避嫌，不在联合调查组的成员名单中是可以理解的。然而，这也很难解释，联合调查组成立和介入的时间，为什么不是在最高法兑现对公众有所回应的承诺之后。
值得注意的是，几乎与中央政法委当晚公布成立联合调查组介入的同时，最高法党组迅速做出回应，称最高人民法院党组召开会议，坚决拥护中央政法委牵头的联合调查组调查“千亿矿权案”卷宗丢失等问题，将全力配合联合调查组工作。
这说明，事已至此，情势发展已比较明确。山雨欲来风满楼，中国最高法院，或许在该事件中已经无法得到高层的信任，而其原本“大事化小息事宁人”的最后防线也已经因为崔永元的举报而被突破。正如早年《人民日报》旗下公众号“侠客岛”预言——好戏在后头。 …转自多维新闻网
